SECTION III: LEGAL, ECONOMIC, FINANCIAL AND TECHNICAL INFORMATION
III.1) Conditions relating to the contract
III.1.1) Deposits and guarantees required: Professional indemnity insurance (5 000 000 GBP cover required).
III.1.2) Main terms of financing and payment and/or reference to the relevant provisions: Will be contained in the tender documents.
III.1.3) Legal form to be taken by the grouping of suppliers, contractors or service providers to whom the contract is awarded: Where
the request to participate is submitted by a group of service providers, each will be required to contract with the awarding authority in a joint
and several liability basis. The group will provide a single address and contact name responsible for the receipt and processing of tenders and
any other matters relative to the contract.
III.2) Conditions for participation
III.2.1) Information concerning the personal situation of the contractor, supplier or service provider and information and formalities
necessary for the evaluation of the minimum economic, financial and technical capacity required: Applicants must submit details of their
experience and understanding of work relating to similar projects and must include details (with precise values and the exact roles played) of
similar commissions that they have carried out in the last five years and the names of clients for those projects.
III.2.1.1) Legal position - means of proof required: Unless the information requested has been submitted to the council within eighteen
months of the publication date of this notice, the following data is also required: policies regarding mainstreaming equal opportunities, the
environment, health and safety at work, continuous professional development and training of staff, full details and curriculum vitae of
managers and staff that would be employed to undertake this project, a description of technical facilities and resources, details of
accreditations or certifications by recognised quality assurance agencies or other agencies of recognised competence, attesting that services meet
pan-European standards, and any other data that applicants feel is important in support of their request to participate.
III.2.1.2) Economic and financial capacity - means of proof required: Company annual reports or financial statements covering the last
three years are also required, unless the information requested has been submitted to the council within eighteen months of the publication date
of this notice. If this data has already been supplied, the formal request to participate submission should contain references to the
relevant dates and project reference numbers.
III.2.1.3) Technical capacity - means of proof required: The service provider must have considerable experience of the provision of the above
services and must employ suitably skilled staff with senior staff especially having appropriate professional qualifications, which will
include corporate membership of the relevant professional body or bodies, for which they may be requested to provide documentary evidence at a
later date.

VI.4) Additional information: Midlothian Council has successfully completed its first Education PPP project with the opening of the
Dalkeith Schools Community Campus, comprising two secondary schools and a special needs school, in October 2003. This second phase of Education PPP
in Midlothian is focusing on the upgrading of primary schools and the amount awarded by the Scottish Executive for this is 50 000 000 GBP
(capital and life-cycle cost). Advisers are required to assist the council's in-house project team in the delivery of this next phase of schools.
Applicants shall provide a statement by the return date outlining their suitability to be invited to tender. The statement should include
information to demonstrate the applicant's knowledge and experience in acting as a technical adviser in the procurement of school PPP projects
together with details of the prospective staff and resources which would be made available to the project.
